InstaEvent Inc. d/b/a Hey Benson™ ("Hey Benson," "Benson," "InstaEvent," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, and protect information when you use InstaEvent.com, HeyBenson.com, the Hey Benson mobile app, AI planning tools, event coordination features, messaging features, invitations, payments, credits, and related services.

Hey Benson is an AI-powered social coordination service. It helps users create events, invite guests, coordinate plans, send reminders, collect RSVPs, suggest places or activities, and use credits for eligible AI-powered and premium features.

We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising unless we clearly disclose that practice and provide any required opt-out rights. We do disclose information to service providers, processors, and platform partners when needed to operate InstaEvent and Hey Benson.

1. Scope of This Policy

This Privacy Policy applies to:

  • InstaEvent.com.
  • HeyBenson.com.
  • The Hey Benson mobile app.
  • Event creation, invitations, RSVPs, reminders, messaging, and group coordination.
  • AI chat and AI planning features.
  • Credits, subscriptions, in-app purchases, and purchase restoration.
  • Support, analytics, security, and fraud prevention.

This Privacy Policy does not replace our Terms of Service, Apple App Store terms, Google Play terms, or the privacy policies of Apple, Google, or other third-party services.

2. Information We Collect

Account Information

We may collect:

  • Username or display name.

Hey Benson may send service-related messages such as invitations, reminders, event updates, cancellations, RSVP notices, OTPs, security alerts, and support responses.

Contacts and Invitees

If you allow contact access, we may process contact information to help you invite people. This may include:

  • Names.
  • Phone numbers.
  • Email addresses.
  • Contact identifiers.
  • Recently invited people.

We do not need to store your entire address book to operate the service. We aim to store only the contacts you invite, interact with, or save inside Hey Benson, plus related invite history needed to provide the service.

If you invite someone who is not yet a Hey Benson user, we may use their phone number or email address to send the invitation you requested.

Location Information

If you enable location access, we may collect or process:

  • Approximate location.
  • Precise location, if allowed.
  • City, region, or country.
  • Event location.
  • Venue search location.
  • Distance between users and potential venues.
  • Location used for recommendations.

Location is used to suggest venues, estimate distance, improve planning, support maps, and coordinate events. You can disable location permissions through your device settings, though some features may not work properly without location access.

Device, Usage, and Diagnostic Information

We may collect:

  • IP address.
  • Device type.
  • Device identifiers.
  • Operating system.
  • App version.
  • Browser type.
  • Language settings.
  • Time zone.
  • Crash logs.
  • Performance logs.
  • Feature usage.

We use this information for app functionality, analytics, troubleshooting, security, fraud prevention, and improving InstaEvent and Hey Benson.

Payment, Credit, and Purchase Information

Hey Benson may sell credits, subscriptions, or other eligible digital features through Apple In-App Purchase and Google Play Billing where required.

When you buy credits, subscriptions, or digital features through Apple or Google, Apple or Google processes the payment. We do not receive or store your full credit card number, debit card number, bank account number, CVV, Apple ID password, Google password, or full payment credentials.

We may receive, collect, generate, or store purchase-related information such as:

  • Hey Benson account ID.
  • Apple or Google transaction ID.
  • Purchase token.
  • Receipt data.
  • Product ID.
  • Subscription ID.
  • Credit package purchased.
  • Credit balance.
  • Purchase date and time.
  • Renewal status.
  • Cancellation status.
  • Refund status.
  • Chargeback status.
  • Trial status.
  • Storefront, country, currency, and price information.
  • Purchase restoration records.
  • Fraud, abuse, or billing-risk signals.
  • Tax, accounting, and compliance records.

  • Add credits to your account.
  • Maintain your credit balance.
  • Restore eligible purchases.
  • Confirm purchase validity.

  • Process refunds or cancellations through Apple or Google where applicable.

Refunds for purchases made through Apple or Google are generally handled by Apple or Google under their applicable policies.

3. SMS/MMS Messaging

We may send SMS or MMS messages for service-related purposes, including:

  • Invitations.
  • Reminders.

  • RSVP notices.
  • OTPs.
  • Security alerts.
  • Support messages.

Your mobile information will not be sold or shared with third parties for their marketing or promotional purposes.

If a Hey Benson user invites a person who has not joined Hey Benson, that person may receive a one-time invitation initiated by the user. Further SMS communications may require consent where required by law. SMS messages may include opt-out instructions such as STOP and support instructions such as HELP.

Message and data rates may apply. Carriers are not responsible for delayed or undelivered messages.

4. How We Use Artificial Intelligence

Hey Benson uses AI to help users plan, coordinate, and complete events. AI features may be used to:

  • Understand planning intent.
  • Suggest venues, activities, dates, or times.
  • Generate event descriptions.
  • Generate invitation copy.
  • Generate or customize event images.
  • Summarize event plans.
  • Help coordinate RSVPs and updates.
  • Remember preferences where enabled.

Your prompts, messages, event details, preferences, and related context may be processed by AI providers or infrastructure providers to deliver these features.

AI output may be incomplete, inaccurate, outdated, or inappropriate. You are responsible for reviewing important details, including location, time, price, availability, accessibility, safety, and venue policies before relying on a suggestion.

We do not use AI to make automated decisions with legal or similarly significant effects about you.

5. How We Use Information

We use information to:

  • Provide and operate InstaEvent and Hey Benson.
  • Create, update, cancel, and coordinate events.
  • Send invitations, reminders, RSVP notices, OTPs, support messages, and event updates.
  • Provide AI chat, AI planning, recommendations, and image features.
  • Maintain credits, subscriptions, purchases, balances, and restoration records.
  • Process refunds, cancellations, billing support, and fraud reviews.
  • Personalize recommendations and remember preferences.
  • Improve our products, services, websites, and user experience.
  • Provide customer support.
  • Monitor performance and troubleshoot errors.
  • Protect against fraud, abuse, spam, security threats, and misuse.
  • Comply with legal, regulatory, tax, accounting, and platform obligations.

  • Other users and invitees: event details, host information, RSVP status, chat messages, guest names, and updates may be visible to people involved in the event.
  • Service providers and processors: vendors that help us provide hosting, storage, authentication, AI processing, messaging, email delivery, SMS delivery, analytics, crash reporting, support, payments, fraud prevention, and security.
  • Apple and Google: for in-app purchases, billing, subscriptions, receipt validation, refunds, purchase restoration, and platform compliance.
  • AI providers: to process prompts, messages, and context needed to generate AI responses or images.
  • Communication providers: to send SMS, email, push notifications, invitations, OTPs, reminders, and updates.
  • Maps, venue, weather, and recommendation providers: to support location, mapping, venue, availability, weather, and recommendation features.
  • Professional advisors: lawyers, accountants, auditors, insurers, and consultants.
  • Legal and safety authorities: where required by law, subpoena, court order, legal process, or to protect rights, safety, users, or the service.
  • Business transaction parties: in connection with a merger, acquisition, financing, restructuring, bankruptcy, or sale of assets.

We do not sell your personal information.

9. No Sale of Personal Information

We do not sell personal information for money. We also do not knowingly sell or share the personal information of children.

If our advertising, analytics, or marketing practices ever constitute "sharing" or targeted advertising under applicable law, we will provide required disclosures and opt-out rights.

  • Account information is generally retained while your account is active.
  • Event information is retained while needed to provide event history, coordination, support, legal compliance, and safety.
  • AI memory and preferences may be retained until you delete them, ask us to forget them, or delete your account, subject to legal retention needs.
  • Purchase, credit, receipt, refund, tax, accounting, and fraud records may be retained longer where required for legal, accounting, platform, or fraud-prevention purposes.
  • Support records may be retained to resolve issues and improve service.
  • Security logs may be retained to detect abuse and protect the service.

When information is no longer needed, we may delete, de-identify, or aggregate it.

Depending on your location and applicable law, you may have rights to:

14. App and Device Controls

You can manage certain data permissions through your device or app settings, including:

  • Contacts.

  • Camera.
  • Microphone, if applicable.
  • Push notifications.
  • Tracking or analytics controls, where available.

Disabling permissions may limit certain features.

15. Marketing Communications

We may send marketing communications where allowed by law. You can opt out of marketing emails by using the unsubscribe link or contacting us. You can opt out of non-essential SMS messages by replying STOP where supported.

You may still receive service-related messages, such as event invitations, reminders, OTPs, security alerts, purchase notices, account notices, support responses, and important policy updates.

16. Children’s Privacy

Hey Benson is not directed to children under 18. We do not knowingly collect personal information from children under 18. If we learn that we collected information from a child under 18, we will take reasonable steps to delete it.

17. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information. These may include encryption, access controls, monitoring, secure development practices, and vendor controls.

No system is completely secure. We cannot guarantee that information will never be accessed, disclosed, altered, or destroyed.

Our service may link to third-party websites, apps, venues, booking providers, restaurants, maps, payment platforms, or other services. Their privacy practices are governed by their own policies. We are not responsible for third-party privacy practices.
